1. Introductory Provisions

These Terms of Use (hereinafter: the “Terms of Use”) govern access to and use of the website available at villapauza.com (hereinafter: the “Website”).

A person who accesses or uses the Website is hereinafter referred to in these Terms of Use as the “User”.

Before using the Website, the User must read these Terms of Use. If the User does not agree with them, they should cease using the Website.

2. Purpose of the Website and Relationship with the General Terms and Conditions

The Website provides information about Villa Pauza, its features, facilities, location and related services and enables users to contact the Company and submit an accommodation reservation request.

The reservation process, conclusion of a distance agreement for the provision of accommodation services, fees and other payments, amendment and cancellation of reservations, the rights and obligations of users of accommodation services and other matters relating to reservations and stays at Villa Pauza are governed by the Booking Terms and Conditions, the specific Offer issued by the Company and applicable mandatory laws.

In the event of any conflict between these Terms of Use and the General Terms and Conditions or the Offer, the General Terms and Conditions and the Offer shall apply to matters relating to reservations and stays.

3. Permitted Use of the Website

The User may use the Website solely for lawful purposes and in accordance with its intended purpose, in particular for:

  • viewing information about Villa Pauza and related services;
  • contacting the Company;
  • submitting legitimate enquiries and reservation requests; and
  • using other functionalities available on the Website in accordance with their intended purpose.

The User is responsible for the accuracy of the information entered or submitted through the Website and must use the Website in good faith and in a manner that does not prejudice the rights and interests of the Company, other users or third parties.

4. Prohibited Use of the Website

In particular, the User must not:

  • use the Website for unlawful, fraudulent, misleading or abusive purposes;
  • access or attempt to access the Website, servers, user accounts, databases or connected systems without authorization;
  • introduce or transmit viruses, malicious code or other harmful technologies;
  • interfere with or compromise the operation, security, availability or technical features of the Website;
  • circumvent the Website’s security measures or other technical restrictions;
  • impersonate another person or intentionally provide inaccurate or misleading information;
  • use automated systems to access the Website in a manner that places a disproportionate burden on its infrastructure;
  • systematically collect, extract, download or reproduce Website content without prior written authorization; or
  • use Website content for commercial purposes without the prior written authorization of the Company or another rights holder.

If the Company reasonably suspects that the User is using the Website contrary to these Terms of Use or applicable laws, it may restrict or disable the User’s access to the Website to the extent technically feasible and reasonably necessary to protect the Website, the Company, other users or third parties.

5. Intellectual Property Rights

Unless otherwise indicated, the content available on the Website, including text, photographs, videos, graphics, plans, designs, logos, trademarks, names, content layout and other materials, is owned by the Company or used with the permission of the relevant rights holder and is protected by applicable intellectual property laws.

Without prior written authorization from the Company or another rights holder, Website content may not be reproduced, published, modified, adapted, distributed, sold, licensed, publicly displayed, commercially exploited or otherwise used, except where such use is expressly permitted by applicable laws.

Use of the Website does not transfer or assign any intellectual property rights to the User, other than the limited right to access and use the Website in accordance with these Terms of Use.

6. Photographs and Audiovisual Content

Photographs, videos and other visual or audiovisual content of Villa Pauza published on the Website are protected by copyright and other applicable intellectual property rights.

Such content may not be downloaded or used for commercial purposes, published, distributed or used in advertising, media or editorial content, on social media, property listing platforms or in other commercial materials without the prior written authorization of the Company or another rights holder.

7. Third-Party Links, Content and Services

The Website may contain links to third-party websites and services, as well as content or functionalities provided by third parties.

Such links, content and functionalities are provided for users’ information or to enable certain Website functionalities.

Unless expressly stated otherwise, the Company does not operate third-party websites or services and cannot guarantee their continued availability, the accuracy of their content, their security or the practices of those third parties concerning privacy and personal data. Access to and use of third-party services may be subject to their terms of use and privacy policies.

8. Website Availability and Security

The Company aims to ensure the availability and proper functioning of the Website but does not guarantee that the Website will be continuously available or operate without technical difficulties or errors at all times.

The Company may temporarily modify, restrict, suspend or disable access to the whole or any part of the Website for maintenance, security, technical work, functionality improvements, troubleshooting or other legitimate reasons.

Where reasonably possible, the Company will provide advance notice of planned interruptions or significant restrictions on the availability of the Website.

9. Informational Nature of Content

The Company exercises reasonable care to ensure that Website content is accurate and up to date. However, Website content may be changed from time to time or may contain inadvertent errors.

Information published on the Website that is relevant to a specific reservation must be considered together with the General Terms and Conditions and the specific Offer issued by the Company. In the event of any discrepancy, the information stated in the Offer shall prevail, in accordance with the General Terms and Conditions.

10. Liability

The User uses the Website at their own risk and in accordance with its intended purpose, these Terms of Use and applicable laws.

To the extent permitted by applicable laws, the Company shall not be liable for damage arising as a result of:

  • use of the Website contrary to these Terms of Use or its intended purpose;
  • unauthorized or unlawful conduct by the User or a third party;
  • temporary unavailability of the Website caused by maintenance, technical difficulties or circumstances beyond the Company’s reasonable control; or
  • reliance on information of a general nature that has not been confirmed in connection with a specific reservation.

11. Personal Data Protection, Cookies and Accessibility

The Privacy Policy describes how the Company collects and processes users’ personal data and provides information on the use of cookies and similar technologies.

Information on the accessibility of the Website and the reservation process is available in the Accessibility Statement.

12. Amendments to the Website and the Terms of Use

The Company may amend or update the Website and these Terms of Use from time to time, in particular to reflect changes in functionality, technology, business operations or applicable laws.

The amended Terms of Use shall apply from the date of their publication on the Website. The date of the latest amendment is stated at the beginning of this document.

13. Governing Law and Jurisdiction

These Terms of Use shall be governed by the laws of the Republic of Croatia.

Any disputes relating to the use of the Website shall be subject to the jurisdiction of the competent courts in the Republic of Croatia, unless a User who is a consumer is entitled under applicable mandatory laws to bring proceedings before another competent court.

UVJETI KORIŠTENJA

1. Uvodne odredbe

Ovim Uvjetima korištenja (dalje: „Uvjeti korištenja”) uređuju se pristup i korištenje web-stranice dostupne na adresi villapauza.com (dalje: „web-stranica”).

Web-stranicom upravlja sljedeće trgovačko društvo:

Osoba koja pristupa web-stranici ili se njome koristi u ovim se Uvjetima korištenja naziva „korisnik”. Korisnik je prije korištenja web-stranice dužan upoznati se s ovim Uvjetima korištenja. Ako se korisnik s njima ne slaže, treba prestati koristiti web-stranicu.

2. Svrha web-stranice i odnos prema Općim uvjetima poslovanja

Web-stranica pruža informacije o Vili Pauza, njezinim obilježjima, sadržajima, lokaciji i povezanim uslugama te omogućuje korisnicima da kontaktiraju Društvo i podnesu zahtjev za rezervaciju smještaja.

Postupak rezervacije, sklapanje ugovora o pružanju usluge smještaja na daljinu, naknade i druga plaćanja, promjena i otkazivanje rezervacije, prava i obveze korisnika usluge smještaja te druga pitanja povezana s rezervacijom i boravkom u Vili Pauza uređeni su Općim uvjetima poslovanja, konkretnom Ponudom Društva i primjenjivim prisilnim propisima.

U slučaju nesklada između ovih Uvjeta korištenja i Općih uvjeta poslovanja ili Ponude, na pitanja povezana s rezervacijom i boravkom primjenjuju se Opći uvjeti poslovanja i Ponuda.

3. Dopušteno korištenje web-stranice

Korisnik se smije koristiti web-stranicom isključivo u zakonite svrhe i u skladu s njezinom namjenom, osobito radi:

  • pregledavanja informacija o Vili Pauza i povezanim uslugama;
  • kontaktiranja Društva;
  • podnošenja legitimnih upita i zahtjeva za rezervaciju; te
  • korištenja drugih funkcionalnosti dostupnih na web-stranici u skladu s njihovom namjenom.

Korisnik je odgovoran za točnost podataka koje unosi ili dostavlja putem web-stranice te se njome mora koristiti savjesno i na način kojim se ne ugrožavaju prava i interesi Društva, drugih korisnika ili trećih osoba.

4. Zabranjeno korištenje web-stranice

Korisniku osobito nije dopušteno:

  • koristiti web-stranicu u nezakonite, prijevarne, obmanjujuće ili zlouporabne svrhe;
  • neovlašteno pristupati ili pokušati pristupiti web-stranici, poslužiteljima, korisničkim računima, bazama podataka ili povezanim sustavima;
  • unositi ili prenositi viruse, zlonamjerni programski kod ili druge štetne tehnologije;
  • ometati ili ugrožavati rad, sigurnost, dostupnost ili tehničke značajke web-stranice;
  • zaobilaziti sigurnosne mjere ili druga tehnička ograničenja web-stranice;
  • lažno se predstavljati kao druga osoba ili namjerno dostavljati netočne ili obmanjujuće podatke;
  • koristiti automatizirane sustave za pristup web-stranici na način kojim se nerazmjerno opterećuje njezina infrastruktura;
  • bez prethodnog pisanog odobrenja sustavno prikupljati, izdvajati, preuzimati ili reproducirati sadržaj web-stranice; ili
  • koristiti sadržaj web-stranice u komercijalne svrhe bez prethodnog pisanog odobrenja Društva ili drugog nositelja prava.

Ako Društvo osnovano sumnja da se korisnik web-stranicom koristi protivno ovim Uvjetima korištenja ili primjenjivim propisima, može mu ograničiti ili onemogućiti pristup web-stranici, u mjeri u kojoj je to tehnički moguće i razumno potrebno radi zaštite web-stranice, Društva, drugih korisnika ili trećih osoba.

5. Prava intelektualnog vlasništva

Ako nije drukčije naznačeno, sadržaj dostupan na web-stranici, uključujući tekstove, fotografije, videozapise, grafike, nacrte, dizajn, logotipe, žigove, nazive, raspored sadržaja i druge materijale, u vlasništvu je Društva ili se koristi na temelju dopuštenja odgovarajućeg nositelja prava te je zaštićen primjenjivim propisima o intelektualnom vlasništvu.

Bez prethodnog pisanog odobrenja Društva ili drugog nositelja prava nije dopušteno reproducirati, objavljivati, mijenjati, prilagođavati, distribuirati, prodavati, licencirati, javno prikazivati, komercijalno iskorištavati ili na drugi način koristiti sadržaj web-stranice, osim kada je takvo korištenje izričito dopušteno primjenjivim propisima.

Korištenjem web-stranice korisniku se ne prenosi niti ustupa bilo koje pravo intelektualnog vlasništva, osim ograničenog prava pristupa i korištenja web-stranice u skladu s ovim Uvjetima korištenja.

6. Fotografije i audiovizualni sadržaj

Fotografije, videozapisi i drugi vizualni ili audiovizualni sadržaji Vile Pauza objavljeni na web-stranici zaštićeni su autorskim i drugim primjenjivim pravima intelektualnog vlasništva.

Nije ih dopušteno preuzimati ili koristiti u komercijalne svrhe, objavljivati, distribuirati niti koristiti u oglašavanju, medijskim ili uredničkim sadržajima, na društvenim mrežama, platformama za oglašavanje nekretnina ili u drugim komercijalnim materijalima bez prethodnog pisanog odobrenja Društva ili drugog nositelja prava.

7. Poveznice, sadržaji i usluge trećih osoba

Web-stranica može sadržavati poveznice na web-stranice i usluge trećih osoba te sadržaje ili funkcionalnosti koje pružaju treće osobe.

Takve poveznice, sadržaji i funkcionalnosti pružaju se radi informiranja korisnika ili omogućavanja određenih funkcionalnosti web-stranice.

Ako nije izričito drukčije navedeno, Društvo ne upravlja web-stranicama i uslugama trećih osoba te ne može jamčiti njihovu stalnu dostupnost, točnost sadržaja, sigurnost ni postupanje tih osoba u odnosu na privatnost i osobne podatke. Pristup i korištenje usluga trećih osoba mogu podlijegati njihovim uvjetima korištenja i pravilima privatnosti.

8. Dostupnost i sigurnost web-stranice

Društvo nastoji osigurati dostupnost i ispravno funkcioniranje web-stranice, ali ne jamči da će web-stranica biti dostupna neprekidno ni da će njezin rad u svakom trenutku biti bez tehničkih poteškoća ili pogrešaka.

Društvo može povremeno mijenjati, ograničiti, obustaviti ili onemogućiti pristup cijeloj web-stranici ili njezinu dijelu radi održavanja, sigurnosnih razloga, tehničkih zahvata, unaprjeđenja funkcionalnosti, otklanjanja poteškoća ili drugih opravdanih razloga.

Ako je to razumno moguće, Društvo će planirane prekide ili značajnija ograničenja dostupnosti web-stranice unaprijed najaviti.

9. Informativna priroda sadržaja

Društvo ulaže razumnu pažnju kako bi sadržaj web-stranice bio točan i ažuriran. Međutim, sadržaj web-stranice može se povremeno izmijeniti ili sadržavati nenamjerne pogreške.

Informacije objavljene na web-stranici koje su relevantne za konkretnu rezervaciju moraju se razmatrati zajedno s Općim uvjetima poslovanja i konkretnom Ponudom Društva, a koji se primjenjuju u slučaju nesklada.

10. Odgovornost

Korisnik se web-stranicom koristi na vlastitu odgovornost i u skladu s njezinom namjenom, ovim Uvjetima korištenja i primjenjivim propisima.

U mjeri dopuštenoj primjenjivim propisima, Društvo ne odgovara za štetu koja nastane kao posljedica:

  • korištenja web-stranice protivno ovim Uvjetima korištenja ili njezinoj namjeni;
  • neovlaštenog ili nezakonitog postupanja korisnika ili treće osobe;
  • privremene nedostupnosti web-stranice uzrokovane održavanjem, tehničkim poteškoćama ili okolnostima izvan razumne kontrole Društva; ili
  • oslanjanja na informaciju opće naravi koja nije potvrđena u okviru konkretne rezervacije.

11. Zaštita osobnih podataka, kolačići i pristupačnost

Način na koji Društvo prikuplja i obrađuje osobne podatke korisnika te informacije o korištenju kolačića i sličnih tehnologija opisane su u Politici zaštite privatnosti.

Informacije o pristupačnosti web-stranice i postupka rezervacije dostupne su u Izjavi o pristupačnosti.

12. Izmjene web-stranice i Uvjeta korištenja

Društvo može povremeno izmijeniti ili ažurirati web-stranicu i ove Uvjete korištenja, osobito radi usklađivanja s promjenama funkcionalnosti, tehnologije, poslovanja ili primjenjivih propisa.

Izmijenjeni Uvjeti korištenja primjenjuju se od dana njihove objave na web-stranici. Datum posljednje izmjene naveden je na početku dokumenta.

13. Mjerodavno pravo i nadležnost

Na ove Uvjete korištenja primjenjuje se pravo Republike Hrvatske.

Za sporove povezane s korištenjem web-stranice nadležan je stvarno nadležni sud u Republici Hrvatskoj, osim ako korisnik koji je potrošač na temelju primjenjivih prisilnih propisa ima pravo pokrenuti postupak pred drugim nadležnim sudom.
